Registered designs provide a monopoly right which allows the holder the exclusive right to stop the use of the design on any products. Both registered and unregistered designs are a useful weapon in the brand owners' armory against infringers and counterfeiters and provide additional solutions for brand owners. In some jurisdictions, product design may also be protected under unfair competition/passing off legislation as well as copyright law. We have extensive experience of acting for clients both in contentious and non-contentious matters in this sector, and advise clients on the protection of their designs both nationally and internationally. We help them license and exploit their designs, and also regularly act in cases where design rights have been infringed.
